Welcome to CashDevice. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Seller") and CashDevice ("Company", "we", "us"). By using our platform to sell your electronic devices, you unequivocally agree to these Terms.
1. Eligibility & Ownership
- Age Requirement: You must be at least 18 years of age and capable of forming a legally binding contract to sell a device to CashDevice.
- Absolute Ownership: You hereby warrant that you are the sole, lawful owner of the device being sold. The device is sold free of any liens, encumbrances, or third-party claims.
- Stolen Goods Policy: We have a zero-tolerance policy for stolen goods. Every device's IMEI/Serial Number is checked against national and international blacklists. If a device is found to be reported lost or stolen, we will immediately cancel the transaction, seize the device, and surrender it alongside your personal information to the appropriate law enforcement authorities.
- Company/Financed Devices: We do not purchase devices that are financed, leased, under an active EMI plan, or owned by an employer (MDM locked) unless you provide explicit proof of full payoff or authorization.
2. Device Condition & Quoting
The initial quote provided on our website is an estimate contingent upon your accurate representation of the device.
- Accurate Declaration: You are required to accurately truthfully answer all questions regarding the device's physical condition, functional status, battery health, and accessory availability.
- Physical Inspection: The final transaction value is entirely subject to a physical and diagnostic inspection performed by our executive at the time of pickup.
- Quote Validity: Assuming market conditions remain stable, an online quote is generally valid for 3 days (72 hours) post-generation. We reserve the right to alter the quote if market prices crash.
- Quote Revisions: If our executive finds discrepancies between your online declaration and the physical device (e.g., hidden scratches, display burn-in, malfunctioning buttons), the quote will be revised downwards locally. You are under no obligation to accept the revised quote. If you decline, the pickup is canceled at no cost to you.
3. User Responsibilities Prior to Handover
- Create a backup of all personal data, photos, and files.
- Log out of all Cloud accounts (iCloud, Google, Samsung). Activation locked devices will be rejected.
- Remove all physical SIM cards and microSD cards.
- Perform a complete Factory Data Reset.
CashDevice assumes absolutely no responsibility or liability for any personal data, sensitive information, or memory cards left inside the device after the handover protocol is complete.
4. Pickup and Handover Process
- Scheduling: Pickups are scheduled based on slot availability in your pin code. We strive to adhere to the chosen time slot but do not guarantee exact timings due to traffic or weather conditions.
- Right of Refusal: Our executives reserve the right to refuse the pickup of any device if they suspect fraud, if the device is structurally unsafe (e.g., swelling battery), or if the user exhibits abusive behavior.
- Transfer of Risk: The title of ownership and risk of loss transfers from you to CashDevice the moment you hand over the device and the payment is successfully credited to your account.
5. Payment Terms
Payments are processed instantly at your doorstep via UPI (IMPS) or direct Bank Transfer. In rare cases of banking downtime or payment gateway failures, the payment may be delayed. CashDevice guarantees full payment for accepted devices. We do not pay in physical cash exceeding legal limits.
6. Limitation of Liability & Indemnity
To the maximum extent permitted by applicable law, in no event shall CashDevice, its directors, employees, or agents be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including damages for loss of profits, goodwill, use, or data.
You agree to indemnify, defend, and hold harmless CashDevice from any and all claims, liabilities, damages, losses, or expenses arising from your violation of these Terms or your provisioning of a stolen, encumbered, or counterfeit device.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.
